Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of compressed gas under pressure, flammable or explosive gas mixtures or exposure to poisonous, toxic or corrosive materials, while engaged in the shearing or shredding of scrap metal: (a) At the National Compressed Steel Corporation Metal Yard, the employer did not provide a proper program, nor were employees adequately trained in the safe handling, storage and disposition of unserviceable compressed gas cylinders. Among other methods, one feasible and acceptable method to correct this hazard can be accomplished by establishing a procedure designed to safely handle and properly dispose of unserviceable compressed gas cylinders, or institute management controls designed to prohibit the introduction of unserviceable compressed gas cylinders into the scrap metal processing operations. Elements of the abatement program shall include but not necessarily be limited to the following: (1) Establish a written procedure designed for the safe handling, proper storage and safe disposal of unserviceable compressed gas cylinders and its' contents. Such a procedure shall be in accordance with the recommendations outlined in the Compressed Gas Association's Handbook of Compressed Gases, Part 1, Chapter 6, Section E. (2) Instruct and train employees in the procedure to ensure that unserviceable compressed gas cylinders are identified, safely removed and properly stored until disposed of in a safe manner.
