Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: Employees were exposed to fall hazards of approximately six and one-half feet in the Main Freezer and approximately 18 feet in the Produce Area while being raised and lowered by forks on the Barett industrial trucks. An employee standing on the forks of an industrial truck in the Main Freezer was being raised and lowered to count product and an employee standing on a wooden pallet, checking temperature of apples in the Produce Area, being raised and lowered by forks on an industrial truck were not protected from the fall hazard through the use of standard railing or the equivalent, nor was the pallet secured to the lifting carriage and/or forks. One feasible and acceptable abatement method, among others, to correct this hazard is to provide a safety platform with standard railings and toeboards firmly secured to the lifting carriage and/or forks.
