Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 50 feet to the ground below because the counterweights were not fastened to the outrigger beams. a)An employee was working from an aluminum plank supported by two outrigger beams that were placed on the top grits of two manually propelled mobile scaffolds. Each beam was counterweighted by three 75 pounds square weights. The weights were not secured from moving either east (towards the scaffold) or west (where they could slide off of the aluminum beams) which would affect the balancing of the scaffold. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the Safety Guidelines published by the Scaffold Industry Association, Inc., which requires that counterweights used with outrigger beams must be of a non-flowable material and fastened to the beam.
