Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while being lifted on a forklift to retrieve furniture from racking system. a) At the time of the inspection, the Crown order picker with attached cart, was not provided with guard rails or other fall protection for employees using it to retrieve furniture from rack system. At times, the lift and cart is more than 11 feet above the floor. While ultimate responsibility for correcting the hazard rests with the employer, given his/her superior knowledge of the work place, feasible and acceptible methods to correct this hazard, among others are: (1) Follow guidelines listed in the American National Standards Institute (ANSI) B56.1, Safety Standard for Powered Industrial Trucks, section 4.17 - Elevating Personnel - with a High Lift Truck designed to elevate personnel and provide restraining means such as railings, chains, cable, body belts with lanyards, or deceleration devices, that are in place and properly used. (2) Follow guidelines listed in American National Standards Institute (ANSI) A64.1, Requirements for Fixed Industrial Stairs, section 3.1 - Where Fixed Stairs Are Requires - for access to elevations which requires regular travel between levels. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.ion
