Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to its employees, in that, employees at the Sewaren Plant were exposed to: a/ The hazards of fire and explosion on June 11, 1996 as a result of not having in place a Management of Change Procedure covering blending operations in accordance with Section 4.6 of API 2610. A feasible and useful method of correcting these hazards includes the development of a Management of Change Procedure for gasoline blending operations at the Sewaren Plant.
