Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees due to exposure to fire and smoke: (a) McCrory Store, Store #6505, (J.J. Newberry's), Hicksville, NY; Employees did not receive training on how to evacuate or escape from the store in a fire or other emergency nor were they afforded an opportunity to participate in fire drills; on or about 5/12/91. ABATEMENT NOTES: Among other methods, one feasible method to eliminate or to materially reduce this hazard is to enforce the pre-existing McCrory Corporation plan contained in the McCrory Operations Manual, (Volumne II, Section 2014), "Emergency Precautions", which includes the requirements for both employee training in excavation procedures and their participation in fire drills.
