Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falling 16ft 6 inches to concrete walking surface. Location: Aisle 700 "D" Basement area 55 Hunter Lane Elmsford N.Y. On or about 4/30/94 a) At approx.9 P.M. employee was being elevated by a Crown Reach forklift s/n 98617 model # 35rrtt while kneeling on unprotected and unsecured wooden pallet to count inventory "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECTS THIS HAZARD IS...." 1. To use a safety platform secured to the lifting carriage and/or forks as stipulated by A N S I B 56-1-1975 section 42 and 513A American National Standard for Powered Trucks ,both low and high lift types.
