Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
in an elevator shaft were exposed to the hazard of falling from upper
levels to the elevator pit
and exposed to falling from and/or falling with an elevator car-sling and
platform free falling
from upper levels and/or being struck by a free falling elevator car-sling
and platform and/or
its components:
Location:  Construction Site:  B2 shaftway, "The Westchester", White
Plains, NY:
On or about 6/16/94:
a) The employer did not properly rig sling(s) to support an elevator
car-sling and platform used
as a work platform in the installation of an elevator system, thereby
exposing
employees who
were not protected by the use of safety belts/harnesses and lifelines to
falls of approximately 60
feet.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS THE ESTABLISHMENT AND
ENFORCEMENT OF ADEQUATE SAFE OPERATING PROCEDURES. ELEMENTS
ESSENTIAL TO A SAFE OPERATING PROCEDURE INCLUDE, AT A MINIMUM, THE
FOLLOWING:
i) Rigging is to be in accordance with OSHA and ANSI standards;
ii) Employees working on the elevator car-sling and platform will be
protected against
falls by the use of safety belts/harnesses attached to lifelines;
iii) The employer will provide training and education in appropriate, safe
operating
procedures for employees engaged in elevator installation.
On or before 6/16/94:
b) The employer did not have the governor roped and the safeties made
operational prior to the
hoisting of the car-sling and platform as is in accordance with:
1National
Elevator
Manufacturing Industry, Inc., manual entitled, "Installation Manual, Basic
Field Practices for
Installation of Elevator and Escalator Equipment", April 1970 edition,
which states on page 268
of Chapter 9, section -c1, "Before raising the elevator, the governor rope
must be installed and
the safety device made operational."; and 2- National Elevator Industry
Educational Program
training manual entitled, "Module 7, Car and Counterweight Assembly and
Roping, Unit 2
Elevator  Rope and Roping" (pages 18 and 20), 1991 edition, which states,
"Before you lift the
car, ensure the governor rope is installed and the safety device is
operating.", and, "The
governor and safety devices must be working before hoisting the working
platform to the top
for roping."; employees exposed to falling from and/or falling with an
elevator car-sling andplatform free falling from upper levels to the
elevator
pit and/or being struck by a free falling
elevator car-sling and platform and/or its components:
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
i) Follow the recommended industry practice as described in chapter 9 of
the National
Elevator Manufacturing Industry, Inc., manual entitled, "Installation
Manual, Basic Field
Practices for Installation of Elevator and Escalator Equipment", April
1970 edition, and
by the National Elevator Industry Educational Program on pages 18-21 of
their training
manual entitled, "Module 7, Car and Counterweight Assembly and Roping,
Unit 2,
Elevator Rope and Roping", 1991 edition, to rope up the governor and
insure that the
safeties are made operational prior to hoisting the car-sling and platform.
THE DOVER ELEVATOR COMPANY, INC., WAS PREVIOUSLY CITED FOR A
VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS
EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD, SECTION 5 (a)(1) OF THE
ACT, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 017748013,
CITATION NUMBER 1, ITEM NUMBER 6, ISSUED ON 6/1/90, AND WHICH BECAME
A FINAL ORDER ON 6/10/92.
