Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  the
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
the hazard of falling out of the bucket of a hydraulic excavator while it
is being raised or
lowered and/or while working from inside of the bucket while it is in a
raised condition:
Location:  Construction Site:  Metro North Wheel True Facility, Harmon
Yard, Croton, NY.
a) On or about 05/24/94, employee riding in and working from the bucket of
the CAT 330 L
excavator was exposed to falls of approximately 20 feet from the bucket
into an unshored,
unprotected trench excavation.
"Among other methods, feasible and acceptable abatement methods to correct
this hazard
are..."
1.  Prohibit employees to ride in and to work from the bucket of any
hydraulic excavator.
2.  Follow the Construction Industry Manufacturers Association (CIMA)
recommendations
for safe operating procedures contained in their manual, " Safety Manual
for Users,
Operators and Maintenance Personnel - Hydraulic Excavator".
