Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: falls of approximately 50 feet while accessing and egressing the elevated work platform of an aerial lift. Location: Construction Site: North west side, "Specialty Retail" section, "The Westchester", White Plains, NY: On or about 02/22 and 25/94: a) employee(s) exposed to falls of approximately 50 feet while accessing and egressing the elevated work platform of a Grove AMZ 66 Manlift, S/N 20470. "Among other methods, one feasible and acceptable abatement methods to correct this hazard are..." 1. Prohibit employees to access and egress the work platform of any manlift while it is in the elevated position. 2. Instruct employees in the recognition and avoidance of unsafe conditions associated with leaving and entering the basket of aerial lift while in the elevated position. 3. Follow the Equipment Manufactures Institute (EMI) recommendations for safe operating procedures contained in their manual, "Aerial Platform Safety Manual for Operators and Mechanics".
