Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious physical harm to employees in that employees
were exposed to the hazards of ingesting biological toxins:
a- Microbiology Laboratory - On or about 10/25/91, employees
were allowed to mouth pipette bacteria cultures as part of
routine procedures while performing assay test on antibiotics.
Employer's chemical hygiene plan prohibits mouth pipetting and
recommends the use of vacuum or pipette bulbs.  Ingestion of
bacteria culture can cause digestive disturbances
(gastronenterocolitis) and increases the risk of contracting
infectious diseases.
Among other methods, one feasible and acceptable abatement
method to correct this hazard is the use of mechanical pipetts
and pipette aids such as vacuum or suction bulbs as recognized
and recommended in the employers own chemical hygiene plan.
