Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of structural failure and collapse of
structural framing:
a.     6509 Lake Avenue, Williamson, NY., Building #3, second
floor, southwest
section.  On or about 9/17/93, two (2) employees were using
forklifts for
stacking bins of apples of approximately 850 lbs. each.  Two
(2) built-up
laminated columns failed causing the flooring systems to
collapse,, which caused
(1) employee and forklift (Clark model C500F20) to fall to
the first floor this
causing a rupture of the Anhydrous Ammonia refrigerant
lines.  The releasing
of ammonia gas caused the asphyxiation of the employee.
Among other methods one feasible and acceptable abatement method to
correct this hazard is
that all structural changes in the existing framing of the facility be
done with an engineering
plan prepared by a registered professional engineer in accordance with
the New York State
Uniform Fire Prevention and Building Code Part 804, Section 804.1(a) and
New York State
Education Law Article 145 Sections 7201 and 7202.

southwest
section.  On or about 09/17/93, two (2) employees were using
forklifts for
stacking bins of apples of approx. 850 lbs. each.  Two (2)
built-up
laminated
columns supporting the floor failed causing the flooring system
to collapse.  The
flooring systems consisting of carrying beams, column cap
plates and floor joists
were not positively connected together.  When the flooring
system collapsed (1)
employee and a Clark forklift model C500F20 fell to the first
floor.  During the
collapse the Anhydrous Ammonia refrigerant lines were ruptured.
The release
of ammonia gas caused the asphyxiation of the employee.
Among other methods one feasible and acceptable abatement method to
correct this hazard is
that all structural members including columns and bemas be properly
designed and erected in
accordance with generally accepted engineering principles and all
structural framing members
be positively connected together in accordance with the American
Institute of Timber
Constructions, "Timber Construction Manual", Typical Construction Details
(AITC 104-72) pgs.
10, 11 and 13 figures #18, 21, 28 and 29.
