Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to the hazard of being run-over by a hydromilling machine which
could result in permanent disability and/or death:
a.   AT THE JOBSITE:  Bridge deck, Rt. 695 Northbound to
I-690 Westbound BIN #1093280 Solvay, NY 13209;
employees
were operating a Flow Hydromilling machine
Co. #5 by standing between the front and rear tires
(24 inches in diameter and 12 inches wide).  During
the operation of this hydromilling machine employees
move the machine short distances to observe the cut
being made or to reposition machine to start a new
cut.  During the moving of the machine the employees
are not only positioned between the front and rear
tires but they also have to operate a shift lever
mounted on the floor of the machine, shift lever is
located approximately 25 inches from outside edge of
tires.  The shift lever activates a closed loop
hydrostatic
transmission which moves the hydromilling
machine forward and or reverse.
Among other methods one feasible method to reduce this hazard is to:
1)   Install operators seat and seat belt;
2)   Extend handle of shift lever beyond point where employees
would have to be positioned between tires, also provide
a "deadman" type device on shift lever; and
3)   Install a shroud or physical barrier to cover and extend
beyond outside edge of tires so that employees would not
be positioned between the tires.
