Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of fire and explosion that could cause death
or serious burns
resulting from inappropriate operating procedures for the prevention of
over filling and spillage
of solvent storage tanks:
a)Tank Farm Area, Solvent Storage Tanks:  Exterior tanks on north and
south side
of process building were not equipped with over fill alarms and automatic
pump
shut- offs, on or about 06/14/95.
Abatement note:  One feasible and acceptable method of abatement to
correct this hazard is to
establish and enforce those procedures, such as:  that stipulated by the
NFPA 30 Flammable and
Combustible Code 1993 edition, chapter 2, Tank Storage, paragraph 2-3-4
Controlling Spillage
from above ground tanks.
