Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck by welded heat exchanger tube
sections that ejected
when non-pressure vessels were subjected to air pressure for weld leak
testing:
a) KThe employer approved the application of air pressure to enclosed
canon immersion tubes
for weld leak testing during heat exchanger manufacture.  KFeasible
control methods and
acceptable industry practices for non-destructive leak test methods
include hydrostatic, liquid
penetration (LPT) or magnetic flux for checking weld quality on sealed
vessels with welded
seams and heads.  Industry practices and guidelines also include
establishing written procedures
for the performance of leak tests, classes of welding to be used, and for
the selection of welder
qualifications.
