Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to potential injury from crushing caused by the unexpected
lowering of hydraulic vehicle lift or shifting of vehicles while
employees working under the vehicle lift:
(a)  On or about April 28, 1992, at the establishment on Highway
137 South, in Licking, Missouri, the vehicle hydraulic lift was
inspected and found not to be provided with a safety latch or
safety bar to prevent the lift from lowering unexpectedly, when
raised; while vehicle is suspended employees are working under
the hydraulic lift.
While ultimate responsibility for correcting the hazard rests with
the employer, given his/her superior knowledge of the workplace,
feasible and acceptable methods to correct this hazard, among
others are:
(1)  Install a safety latch on the hydraulic cylinder;
(2)  Install a safety bar on the lift; and
(3)  Develop and implement a visual inspection on the vehicle
hydraulic lift to ensure it is in safe operating condition at
the beginning of each shift.
