General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a)  Job site at 25th and Summit, Kansas City, Missouri.  An
employee performing sand blasting operations on December 2, 1992,
was exposed to lead-containing dust at a time-weighted average
(TWA) exposure level of 0.17mg/m3, approximately 3.4 times the
general industry permissible exposure limit (PEL) of 0.05mg/m3;
the exposure level was derived from 2 samples collected over a 500
minute sampling period.  The general industry PEL for lead is
established because of the cumulative nature of lead in the body
and its toxic effects.  OSHA believes that the construction PEL of
0.200mg/m3 does not adequately protect employees from the hazard
of lead; and
(b)  Job site at 25th and Summit, Kansas City, Missouri.  An
employee performing sand blasting helpers duties on December 2,
1992, was exposed to lead-containing dust at a TWA exposure level
of 0.083mg/m3, approximately 1.7 times the general industry PEL of
0.05mg/m3; the exposure level was derived from 2 samples collected
over a 543 minute sampling period.  The general industry PEL for
lead is established because of the cumulative nature of lead in
the body and its toxic effects.  OSHA believes that the
construction
PEL of 0.200mg/m3 does not adequately protect employees from
the hazard of lead.
General methods of control applicable in these circumstances
include, but ar not limited to, the following:
(1)  Establishment of a local exhaust system to remove the
dust from the point of generation;
(2)  Placement of dust shields/curtains to prevent entry of
dust into operators station; and
(3)  Administration rotation of employee to a less dusty
location/operation.
Ultimate responsibility for determining the most appropriate
abatement method rests with the employer, given its superior
knowledge of the specific conditions at its worksite.
