Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to:
(a)  On west side of conveyor belt system #1, between Sample House
and old Crusher House, on 3/29/93, employee was working on a light
lamp connected to conveyor belt catwalk guard railing.  He was
standing with his right foot on the top rail of guard railing for
catwalk, braced against pole, and left foot on the water pipe on
conveyor belt housing without any fall protection.  The elevation
of height was 13 feet, 2 inches.
While ultimate responsibility rests with the employer given his/her
superior knowledge of the workplace, among others, is to establish
and implement employee use of safety belts and lanyards attached to
a suitable mounting point.  Essential elements would include:
1.  Provide a horizontal mounting cable above the length of each
conveyor belt housing at interval, when used as a tie-off point for
the lanyard attached to employee's safety belt, would limit falls
to six feet or less.
2.  Train employees in effective use of the device.
3.  Provide safety belts and lanyards and enforce use by all
employees exposed to falls from elevations.
4.  Provide an aerial lift in area where ample room is available
or other effective protective means.
