Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential for crushing injuries: (a)Employees were exposed to three auto lifts which had no visible safety valves which prevent the lifts from losing power. No evidence of maintenance existed. While ultimate responsibility for correcting the hazard rests with the employer, given its superior knowledge of the workplace, one feasible and acceptable method, among others, to correct this hazard, is to use 4-point jacks until lifts have been inspected and maintenanced, as recommended in ANSI-ALOIM 1994 (Automotive Lift Institute).
