Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
(a)  Worksite at West Highway 76, Branson, Missouri - On June
6, 1993 at 2:55 PM, an employee was exposed to a fall hazard
while working from the top of an outdoor advertising sign 27
feet above ground level.  The employee was not attached to the
structure with a safety harness and lanyard, and was not
provided with alternative means of fall protection.
While ultimate responsibility for correcting the hazard rests
with the employer, given his/her superior knowledge of the
workplace, one feasible and acceptable method to correct this
hazard, among others, is:
(1)  Provide a mounting cable horizontally located across the
length of the top of the sign which would, when used as a
tieoff
point for the lanyards attached to the employees' safety
harness, limit the distance of a possible fall to six feet or
less;
(2)  rovide safety harnesses andlanyards which are appropriate
for the conditions of use to all affected employees;
(3)  Train employees in the proper use of these devices;
(4)  Provide effective enforcement to ensure that employees
working at elevated heights have suitable fall protection.
