Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to a fall hazard of approximately nine feet to the floor level
below:
(a)  2020 East Dale, Springfield, Missouri - On or about November
18, 1992 at approximately 11 AM, employees were observed
standing
atop steel drums stacked three high, at a height of nine
feet above floor level, while engaged in stacking drums.  None
of the employees had been provided with a means of fall
protection,
thus employees were exposed to a fall hazard.  While
ultimate responsibility for correcting the hazard rests with the
employer, given his or her superior knowledge of the workplace,
one feasible and effective means of correcting this hazard among
others, would be to ensure employee use of an appropriate safety
harness with a lanyard attached to a suitable mounting point.
Essential elements would include:
1.  Provide mounting cables horizontally located across the length
of the Barrel Stacking Area to be used as a tie-off point for
the lanyards attached to employees' safety harnesses;
2.  Provide safety harnesses and lanyards, which are appropriate for
conditions of use, to all affected employees;
3.  Train employees in the proper use of these devices; and
4.  Provide effective enforcement to ensure that those employees
working at elevated heights have suitable fall protection.
