General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and/or explosion: (a) On February 23, 1994, employees working in the four pound repackaging trailer were required to open metal cans containing 16.54 pounds each of AS30 Clays, a smokeless propellant, with a newly designed and fabricated hand held spade-type metal can opener. The mechanical action of the metal can opener on the metal cans containing the smokeless propellant, as well as the force necessary for its use, were contradicted by the employer's own material safety data sheet for AS30 Clays which advised to "not subject the material to percussion, shock, or friction during storage or handling". Among other methods, one feasible and acceptable abatement method to correct this hazard would be to conduct a hazard evaluation of each step of the four pound repackaging process to analyze potential causes and consequences of fires and explosions. Until such time as a hazard evaluation is completed, use the screw cap opening provided by the manufacturer on the top of the metal cans to open the cans.
