Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to being struck by a radio remote control diesel locomotive
due to inadequate operator training:
(a)  Coke Car Loading Station;  There was no formal training
by a qualified instructor;  There was no documentation of the
on-the-job training to indicate content and operator
qualification;  The locomotive inspection reports were not being
done on a daily basis and there was no monitoring of operator
performance.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to provide proper training on a continuing
basis with ongoing monitoring and enforcement for all employees who
could be readily expected to operate the remote controlled locomotive.
