Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Bureau of Mines; Several defects and usage problems present a hazard to employees who are transported from one area to another in the Chevy sports van. They are as follows: (1) The passenger side tire is worn and cracked, (2) The driver's side tire is badly worn, (3) There are several holes in the van (rear door, wheel wells and body near the rear door) through which carbon monoxide can pass. This is a particular problem bacause the van is not properly tuned. (4) The rear sliding door has no handle and (5) Employees who ride in the rear storage area do not have a seat and the protection of seat belts.
