Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or crushing hazards from falling loads: Production Area, the below-the-hook attachment used in the area to lift tubs of chemicals and paint products was not load rated. The employees were exposed to struck-by and/or crushing hazards. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement the following recommendations in accordance with ASME B30.20-1993 Below-the- Hook Lifting Devices: a)Provide the rated load on any custom-made lifting device; b)Design the lifting device to withstand the forces imposed by its rated load with minimum design factor of three; c) Provide initial, frequent and periodic inspections of the lifting devices. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
