Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed crushing hazards: a) Bay 3 - the below-the-hook lifting device had not been load rated, and load testing information was not available for the devices use on the overhead 65 ton capacity crane. The lifting devise is an area where 5 to 50 ton steel products are being lifted. b)Maintenance Store Room - the storage racks along the aisles had damaged feet, legs and support columns due to being struck by the forklifts. The employer did not ensure that the steel storage racks in use at the facility were inspected and maintained in accordance with the manufacturer's requirements and with the American National Standards Institute guidelines for the use of industrial and commercial steel storage racks. Instance a) Among other methods, one feasible and acceptable methods to correct the hazard include, but are not limited to the following recommendations in the Below-the- Hook Lifting Devise, ASME B30.20-1999, Section 1.2.1, Markings. 1.Provide the rated load on any custom made lifting device. 2.Design the lifting device to withstand the forces imposed by its rated load with minimum design factor of three. 3.Provide initial, frequent and periodic inspections of the lifting device. 4.Ensure that the initial proof testing is 125of the rated load was conducted. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement for instance a) of the above violation is completed. Instance b) Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the racks are inspected, repaired and maintained in accordance with Rack Manufacturers Institute (RMI) MH16.1- 2004. 29 CFR 1903.19(c)(2) abatement of the above violation instance b) was verified at the time of inspection. No certification is required.tion
