Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to crushing/struck by hazards:
Conveyor Area and all other areas where damaged racks are located -
sections AA56-02 thru
AA43-01 and AA30 thru AA21 - the supporting legs (8) were not inspected
and repaired where
forklifts and pallets damaged the bottom of the racks supporting 3200
pounds or more of
product.  Employees were exposed to struck by hazards from racks and
contents in the event of
a collapse.
Among other methods, one method of abating this hazard is to develop and
implement a
structural integrity program to periodically  inspect stroage racks as
recommended by the  by
Rack Manufacturers Institute "Specifications for Design, Testing, and
Utilization
of Industrial
Steel Storage Racks." 1997 Edititon, Section 1.4.1.
29 CFR 1903.19(c)(1) requires certification that the abatement of the
above violation is
completed.
