Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to potential injury from falls caused by lack of fall proection
for employees:
(a)  Jobsite, employees working on the roof with a 1 1/2  to 12
pitch, approximately 25 ft. above ground level; were not
wearing a harness and lanyard or utilizing any other type of
fall protection equipment.
While ultimate responsibility for correcting the hazard rests with the
employer, given his/her superior knowledge of the work place, feasible
and acceptable methods to correct this hazard, among others are:
(1)  Provide a mounting cable horizontally located across the length
of the roof which would, when used as a tie-off point for the
lanyards attached to employee's safety belts or harnesses, limit
the distance of a possbiel fall to 6 feet or less;
(2)  Provide safety belts or harness and lanyards, which are
appropriate
for the conditions of use for all affected employees;
(3)  Train employees in the proper use of these devices; and
(4)  Provide effective enforcement to ensure that employees working
at elevated heights have suitable fall protection.
