Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed the hazard of being struck by or being crushed in a rollover caused defective skid steer machine: JOBSITE: A skid steer machine that had defective headlights and damage to the rollover protection had been used and was available for use. Damage to the rollover protection caused the right headlight to have to be held in it's correct position by tie wire. This light also did not work. There were areas on this job, where this machine is used, that headlights were necessary. Employees could get struck by this machine and receive serious injury. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to take the machine out of service until the damage to the rollover protection and headlight is fixed.
