Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by broken chain or the dropping of large building heaters being hoisted and transported by a hydraulic forklift: Jobsite: A chain being used to hoist and travel with large building heaters was not a steel alloy chain. Among other methods, feasible and acceptable abatement methods to correct this hazard are: A.Use steel alloy chain, in accordance with 29 CFR 1910.184 which is the only industry recognized method for hoisting. B. Train employees performing hoisting operations on safe operating procedures.
