Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being hit by falling material: PLANT: ON OR ABOUT MARCH 21, 1996, THE EMPLOYEE UNLOADING MARBLE GRANITE SLABS FROM AN OPEN-TOP TRUCK BED WITH AN OVERHEAD CRANE WAS EXPOSED TO SEVERE PHYSICAL INJURY OR DEATH FROM BEING HIT BY FALLING MARBLE GRANITE SLABS. AMONG OTHER METHODS, ONE FEASIBLE AND ACCDEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO: 1.TRAIN AND INSTRUCT EMPLOYEE(S) TO STAY OUT OF THE TRAJECTORY OF THE SLABS DURING UNLOADING 2.USE A REMOTELY OPERATED CRANE OR HAVE A SUFFICIENT LENGTH OF CABLE ON THE PENDANT CONTROL OF THE CRANE 3.HAVE TWO EMPLOYEES, AT A MINIMUM, ON THE TRUCK BED FOR THE PURPOSE OF MANUALLY GAPPING TO PUT THE GRAB OF THE CRANE ONTO THE SLABS 4.USE OTHER ALTERNATIVE METHOD(S) OF STACKING SLABS ONTO THE TRUCK BED SO THAT THE MANUAL GAPPING BETWEEN SLABS IS NOT NEEDED 5.USE OF OTHER SAFE WAY(S) OF HANDLING SLABS
