Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struckby the swing radius of the superstructure on a excavator: 9 SHOHAM ROAD, EAST WINDSOR, CT 06088: ON OR ABOUT JANUARY 20, 2000, AN EMPLOYEE WALKED BETWEEN THE UNGUARDED SWING RADIUS OF THE ROTATING SUPERSTRUCTURE ON THE ACKERMAN H10 EXCAVATOR AND A METAL WALL WHILE THE MACHINE WAS TURNING, FATALLY INJURING THE INDIVIDUAL. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO BARRICADE THE SWING RADIUS OF THE EXCAVATOR IN SUCH A MANNER AS TO PREVENT THE EMPLOYEES FROM ENTERING THE SWING RADIUS AREA OF THE ROTATING SUPERSTRUCTURE.
