Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: MOHEGAN SUN HOTEL: ON/ABOUT SEPTEMBER 24, 2001, THE BRAKE ASSEMBLY ON CAR "B" OF THE CHAMP HOISTS (ELEVATORS) THAT WERE BEING USED TO HOIST PERSONNEL AND MATERIAL DURING THE CONSTRUCTION OF THE HOTEL MALFUNCTIONED DUE TO DEFECTIVE AND UNSAFE BRAKE ASSEMBLY PARTS. THE CAR WAS NOT TAKEN OUT OF SERVICE UNTIL APPROPRIATE INSPECTIONS AND REPAIRS WERE MADE. FURTHER, THE BRAKE ASSEMBLY ON THE CAR DID NOT HAVE BRAKE PARTS THAT WERE SPECIFIED BY THE HOIST AND BRAKE PARTS MANUFACTURERS. AMONG OTHER METHODS, ONE FEASIBLE AND USEFUL ABATEMENT METHOD TO CORRECT THE HAZARD IS TO: 1.FOLLOW THE MANUFACTURER'S INSTRUCTIONS AND RECOMMENDATIONS BY SCHEDULING AND CONDUCTING APPROPRIATE INSPECTIONS. 2.INSURE THE INSTALLATION OF REPLACEMENT PARTS SPECIFIED ONLY BY THE MANUFACTURERS OR PARTS THAT HAVE ENGINEERING TABULATED DATA EQUIVALENT TO THE MANUFACTURER'S ORIGINAL SPECIFICATIONS. 3.TAKE THE CAR(S) OF HOISTS/ELEVATORS OUT OF SERVICE UPON LEARNING OF DEFICIENCIES IN "BRAKING SYSTEM" AND OTHER IMPORTANT SYSTEMS.
