Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recongnized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended actuation of a foot pedal not protected by a guard: (a)CNC Machine Department - An employee has operated a Buffalo Universal Iron Worker, order number 54W7842, used to punch, shear, and notch pieces. No means was provided to protect the foot pedal from an unintended actuation by a falling or moving objects or by someone accidentally stepping on it. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO GUARD THE FOOT PEDAL. *** Or In The Alternative *** 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by an unguarded foot pedal: (a)CNC Machine Department - An employee has operated a Buffalo Universal Iron Worker, order number 54W7842, used to punch, shear, and notch pieces.
