Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from unintended actuation of a foot pedal/treadle, not provided with a guard. (a)Sheet Metal Shop - Employees operating the NIAGARA Press Brake, Serial Number - A7002129, with no means provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. (b)Sheet Metal Shop - Employees operating the VERSON Press Brake, Serial Number - 13469-206, with no means provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL GUARD. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): (a)Sheet Metal Shop - Employees operate the NIAGARA Press Brake, Serial Number - A7002129, without adequate foot pedal guarding to protect operator(s) and other employees from unintended activation by falling or moving objects or by someone accidently stepping on it. (b)Sheet Metal Shop - Employees operate the VERSON Press Brake, Serial Number - 13469-206, without adequate foot pedal guarding to protect operator(s) and other employees from unintended activation by falling or moving objects or by someone accidently stepping on it.
