Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended activation of the foot pedal which was not protected by a guard: (a)Finishing Room - The Challenge Machinery Company paper drill, serial number 31357, was not provided with a foot pedal guard. No means were provided to protect the foot pedal from the unintended activation by falling or moving objects or by someone accidentally stepping on it. (b)Press Area - The Odin press #TP111, Machine Number 94094, was not provided with a foot pedal guard. No means were provided to protect the foot pedal from the unintended activation by falling or moving objects or by someone accidentally stepping on it. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL GUARD." OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by the pinch point: (a)Finishing Room - The Challenge Machinery Company paper drill, serial number 31357, was not provided with a foot pedal guard. No means were provided to protect the foot pedal from the unintended activation by falling or moving objects or by someone accidentally stepping on it.
