Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended activation of the foot pedal which was not protected by the guard: (a)Shop Area - An unprotected foot pedal was used to activate the Niagara IB60-10- 12 press brake. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL GUARD." OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by pinch points: (a)Shop Area - An unprotected foot pedal was used to activate the Niagara IB60-10- 12 press brake.
