Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Falls from approximately 10 feet off of the top deck of a moving fire truck where they may have been subsequently run over by the vehicle. An employee was riding on the top deck of the E-One fire truck on or about February 4, 1996. The fire truck was being encroached upon by the rapidly spreading ground fire. The truck was moved back out of the fire while an employee was on the top deck. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have all employees remove themselves from their exposed positions prior to moving the truck. The foam pumping mechanism cannot be operated while the vehicle is in motion so there is no reason for the employees to be riding on the exposed deck of the vehicle. The National Fire Protection Association (NFPA) 600 2-7.1.5 prohibits riding in an exposed position on any fire brigade apparatus.
