Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an overloaded dump truck which could travel out of control: (a)Slag Hauling Area - An employee rolled over a Euclid Dump Truck, model 97FD company number R098, with a rated GVW of 84480 lbs that was loaded with an actual loaded GVW of 91200 lbs while hauling slag. The truck was not provided with clearly marked capacity labeling for the operator and there were no procedures in place to prevent overloading of the dump trucks. The resultant overload created an increased strain on the truck and its safety systems, as occurred July 27, 1998. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO CLEARLY LABEL THE TRUCK'S LOAD CAPACITY, IMPLEMENT PROCEDURES TO ENSURE THAT OVERLOADING DOES NOT OCCUR AND REDUCE THE AMOUNT OF SLAG LOADED ONTO THE TRUCK TO WITHIN THE RATED LOAD CAPACITY. VERIFICATION REQUIREDTION

The original parking brake mechanism was not functional and the emergency brake control knob was not labeled, as occurred July 27, 1998. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REMOVE THE PARKING BRAKE LEVER AND LABEL THE EMERGENCY BRAKE BUTTON. VERIFICATION REQUIREDTION
