Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from employees not being restrained in a forktruck in case of tipping and/or rollover. (a)Loading Dock - Employees driving TCM and Toyota forktrucks, that have seatbelts provided, are not wearing the seatbelts. The forktrucks are driven in the vicinity of open sided docks. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELTS AS REFERENCED IN ASME B56.1 - 1993 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" and OSHA'S NEW FORKLIFT TRAINING STANDARD. VERIFICATION REQUIRED
