Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards and that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of explosion and fire from heating asphalt above its flashpoint in an improperly maintained and operated asphalt tanker. (a)Yard Area - The material level safety switch (low level safety switch) on the 1979 Taurus/Liquid Asphalt Systems tanker was not in working condition, as occurred on May 13, 1999. (b)Yard Area - The mounted thermometer was not in working condition, as occurred on May 13, 1999. (c)Yard Area - There were no procedures, including those for operating the pumping mechanism, for safely operating the asphalt tanker, as occurred on May 13, 1999. (d)Yard Area - The mounted thermometer had not been calibrated on a regular basis, as occurred on May 13, 1999. (e)Yard Area - There was no temperature log kept for the tanker, as occurred on May 13, 1999. Among other methods, feasible and acceptable methods to correct these hazards are to fix the material level safety switch; provide an operating mounted thermometer; develop operating procedures; calibrate the mounted thermometer on a regular basis and develop and maintain a written temperature log. VERIFICATION REQUIRED
