Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from the potential dust explosion that could have resulted from, or have been exacerbated by, the location of the dust collector inside of the building, the lack of bonding and grounding the ductwork for the dust collection system, and the lack of magnetic separators or equivalent means to prevent the entry of tramp metal into the dust collection system: (a)Collegiate Furnishings, Incorporated - The Aget dust collector that was used to collect combustible wood dust was located inside of Building 274 and the filtered air was returned to the workplace, on or about January 18, 2007. (b)Collegiate Furnishings, Incorporated - The ductwork used in Building 274 to collect combustible wood dust was not adequately bonded and grounded, on or about January 18, 2007. (c)Collegiate Furnishings, Incorporated - Magnetic separators or similar devices were not provided to prevent the entry of tramp metal into the dust collection system from the floor and equipment intakes located in Building 274, on or about January 18, 2007. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS INCLUDES FOLLOWING NFPA 664, STANDARD FOR PREVENTION OF FIRES AND EXPLOSIONS IN WOOD PROCESSING AND WOODWORKING FACILITIES, 2002 EDITION, INCLUDING BUT NOT LIMITED TO: LOCATE THE DUST COLLECTOR OUTSIDE OF THE BUILDING, PROVIDE COMPLETE BONDING AND GROUNDING OF THE DUCTWORK FOR THE DUST COLLECTION SYSTEM, AND INSTALL MAGNETIC SEPARATORS OR OTHER SIMILAR DEVICES TO PREVENT TRAMP METAL FROM ENTERING THE DUST COLLECTION SYSTEM. PROGRESS REPORT DUE EVERY 90 DAYS - FIRST ONE IS DUE JULY 6, 2007 AND THE SECOND REPORT IS DUE OCTOBER 4, 2007. VERIFICATION REQUIREDTION
