Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing injuries from a falling load with an unrated lifting device: (a)Outside Steel Crane Area - Employees used a spreader bar which had no permanently affixed durable identification stating the rated capacity, the lifting device weight, the serial number and the manufacturer's name and address. There was also no inspection record for the spreader bar, on or about August 2, 2006. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the below-the-hook lifting device has the rated capacity, manufacturer, serial number and lifting device weight and to conduct inspections as outlined in the American Society of Mechanical Engineers Standard for Below-the-Hook Lifting Devices (ASME B30.20 - 1993).
