Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended actuation of a foot pedal not protected by a guard: (a)Kiln Dry Line - The foot pedal for the cut-off was not guarded from accidental contact, on or about September 21, 2006. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO GUARD THE FOOT PEDAL. *** Or In The Alternative *** 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by an unguarded foot pedal: (a)Kiln Dry Line - The foot pedal for the cut-off was not guarded from accidental contact, on or about September 21, 2006.
