Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees, in that employees were exposed to potential lacerations, contusions, fractures or crushing injuries as a result of being struck by loads suspended from lifting devices which have not been tested, certified and marked with their maximum rated load: (a)Plantwide --- Employee(s) utilized a variety of field-made below-the-hook lifting device(s) and/or non-alloy steel chain sling(s) to lift and/or move truck engine, transmission and carrier parts and assemblies, up to and including complete engines, transmissions and carriers. The device(s) and sling(s) had not been proof or load tested and certified, nor marked with their identification, including the manufacturer's name and address, weight and rated load. Examples of such devices and slings included: (1)Receiving Cell -- RI-025 Swivel Hook, RI-03 L-Hook, RI-01 Crank Hook, and CA- F05 Scissor Hook; (2)United Cell, Steam Room Area -- TD-6 Large Stand Lifter, EALF-151 Bar & Chain, and CR-F-012 Bar with Chains; and (3)Basic Engine Cell -- EN-FO56 Lift Basic Engines, on or about October 5, 2004. Among other methods, one feasible and acceptable method of abatement to correct this hazard would be to purchase all below-the-hook lifting devices and steel chain slings from manufacturer(s) who has(have) proof tested their units, provide(s) a certificate of the proof test, and mark(s) the units with appropriate identification, including the manufacturer's name and address, serial number of the device, weight (if over 100 pounds), size, reach and rated capacity or load, as appropriate, (As referenced in ASME B30.20 - 1999 and B30.9 - 1996).
