Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries from mechanical dock levelers which were structurally damaged: (a)J.F. Rohrbaugh Company, Incorporated, 1649 Broadway, Hanover, PA, 17331 - Employees were operating a Mantis dock leveler at Dock 5 with a broken lip. Since the lip was inoperable, employees had to step over a twelve (12) inch gap between the dock leveler and the back of the tractor trailer to lift it, exposing them to slip/trip hazards, on or about May 16, 2011. (b)J.F. Rohrbaugh Company, Incorporated, 1649 Broadway, Hanover, PA, 17331 - Employees were operating a Mantis dock leveler at Dock 6 with a dock platform that did not lock exposing them to slip/trip hazards, on or about May 16, 2011. Among other methods, one feasible and acceptable method to correct these hazards is to comply with ANSI MH30.1 - 2007, Section 5.4.5. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
