Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on May 5, 2004 employees were opening or attempting to open the doors of a stationary box trailer and exposed to pinch points resulting in crushing injuries and death from being struck by a 1989 Volvo Autocar truck equipped with a Finn hydro-seeder being operated in reverse toward the rear of the trailer with a back up alarm that was not audible above the surrounding noise or with out having an observer to signal when it was safe to back up. Among others, one feasible and acceptable abatement method would be to insure the back up alarm was audible above the surrounding noise or to develop and implement a procedure for an observer who is located in a safe position to signal the operator of the truck when it was safe to back up.
