5(a)(1) a.Dry Hill Road - Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to oxygen deficiency hazards and fire hazards. These hazards were due to the company's failure to test the confined space for oxygen levels and percentage of gas levels, and failure to have a recovery system for employee(s) in the confined space. Among others one feasible and acceptable method to abate this hazard is to test the confined space for oxygen levels and explosive gas prior to entry. In addition the employer needs to develop an acceptable recovery system for employees entering confined spaces.
