Section 5(a)(1) of the Occupational Safety and Health Act of
1970:  The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical farm to
employees in that maintenance employees were exposed to the
hazard of developing legionnair's disease resulting from exposure
to legionella pneumophila bacterium:
a.Rooftop Cooling Tower, 550 Eagan Street, Charleston, WV
- A water treatment and disinfection regimen was not
implemented to insure the water reservoir of the
cooling tower was maintained free of infectious
microorganisms, on or about July 22, 1997.
b.Rooftop Cooling Tower, 550 Eagan Street, Charleston, WV
- The employer did not develop written standard
operating procedures on all phases of operation of the
cooling tower which would include treatment and testing
intervals.
c.Rooftop Cooling Tower, 550 Eagan Street, Charleston, WV
- A recordkeeping program recording the dates of
chemical treatments on the cooling tower was not
established.
d.Rooftop Cooling Tower, 550 Eagan Street. Charleston, WV
- A warning sign was not posted on the cooling tower
stating the potential biohazard of legionalla bacteria.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method to correct the hazard in item (a) is to utilize
the procedures outlined in the summary guidelines on "Control of
Legionella in Cooling Tower", issued by the Wisconsin Division of
Health
