Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to fire, explosion and fall hazards:
a.The driller helpers who climb the mast of the spudder rig
were exposed to hazards from fires, explosions, and falls
due to the lack of a "Geronimo" Escape Device at the rig
located on the Rosiek #1 Well site.
Among other methods, one feasible and acceptable method to correct
this hazard would be to install a properly rigged and secured
emergency descent line or other satisfactory auxiliary means of
egress, such as specified in Section 5, Sub Section 5.7 of the
American Petroleum Institute (API), Page No. 12; and the NIOSH
standard entitled "Comprehensive Safety Recommendations for Land-
Based Oil and Gas Well Drilling", Section B. Safety Guidelines for
Well Drilling Machinery and Equipment, Page 73.  Essential elements
of this procedure would include the following:
1.Staking out a securely anchored one-half inch wire rope escape
line attached to the derrick or mast when the mast is first
climbed by the helper so as to provide a ready and convenient
means of escape from the derrick/mast.
2.The escape line route is to be kept clear of obstructions.
3.A safety device is to be provided to permit fast emergency
exit from the derrick/mast.
4.The tension on the escape line is to be periodically checked
and adjusted to assure a safe landing and allowing the
derrickman, or drillers helper to stop at least 20 to 25 feet
from the anchor point.
5.The ground anchor point of the escape line is to be located at
a minimum lateral distance from the derrick or mast equal to
the height above ground level to the point where the escape
line is fastened.

The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to fire and explosions hazards:
a.Spudder Rig - Rosiek #1 Well - Employees were exposed to
the hazard of fire and explosion because of an unknown
quantity of flammable gas that was being used on the mast
floor and doghouse at the well site.  The two natural gas
lines that were tapped from the main line were run into
the doghouse servicing the man made heater and was not
located at least 75' from the well head, the other gas
line ran to the forge and was not located at least 75'
from the well head.
One feasible and acceptable abatement method among others to
correct the hazards is to assure that the well be checked for
pressure and if pressure is indicated, the operators authorized
person should be notified, then proper steps should be taken to
remove pressure or to operate safely under pressure before
commencing operations such as specified in the American Petroleum
Institute standard, Section 5, paragraph 5.3 and the NIOSH standard
entitled "Comprehensive Safety Recommendations for Land-Based Oil
and Gas Well Drilling" Section 9.b. prohibiting open flames to
include all areas with 75 feet of the well head, the prohibition of
heating devices within 75 feet of the well head,  and providing a
heater that has an explosion proof design.
